Argues that the Privy Council, initially, took an inflexible view of the law that mandated a trial judge to give the Turnbull warning as well as the reasons for the warning, regardless of the quality of the identification evidence. Indicates that the implication was that the merits of the particular case were ignored and a blanket rule that admitted no exceptions was applied. Notes that this trend seems to have been reversed in favour of a case-by-case analysis.
